ABSTRACT
The presentation will address ethical issues faced by experts, especially when involved in judicial or administrative proceedings. This includes how and when the concepts of witness immunity and judicial privilege apply to experts involved in litigation. Judicial privilege has key limitations, especially for statements not part of the judicial proceeding. For administrative proceedings, the law is not as well defined. Even with the privilege, many states allow their own clients to sue experts for malpractice. Moreover, judicial privilege does not prevent licensing agencies from examining witness testimony and reports in determining possible violations of licensing obligations. In extreme cases, experts have been subject to civil and even criminal liability; the presentation will include some key concepts of criminal law that experts should consider.
